General Terms and Conditions of Classicpoint.net

1. General
1.1. Masterhomepage GmbH is the owner and invoice issuer of the Classicpoint.net database.
1.2. Classicpoint.net reserves the right to reject entries if their content violates the provisions listed below.
1.3. Classicpoint.net has the right to delete duplicate entries.
1.4. Classicpoint.net is entitled to amend or supplement these terms and conditions, including all appendices such as terms of use and service descriptions, at any time. 1.5.
Delays in service due to force majeure, strikes, lockouts, operational disruptions or failure of communication networks and gateways of other operators, or other disruptions are not the responsibility of Classicpoint.net.
1.6. No refunds will be issued for service outages due to disruptions outside the control of Classicpoint.net.

2. Membership
2.1. Only concerts in Switzerland, Germany, or Austria in the field of classical music may be listed.
2.2. Payment Terms:
2.2.1 A membership period always lasts one year from the order date and must be paid in advance.
2.2.2 A one-time fee of CHF 50.- is charged upon activation as a member.
2.2.3 The annual period can be canceled up to one month before its expiry. After that, the period is automatically extended by one year and invoiced.
2.2.4 Membership activation takes place after receipt of payment.
2.2.5 Outside of Switzerland, prices are in euros and exclude VAT.

3. Obligations
3.1 The client is solely responsible for the content of the advertisements and offers. The client guarantees the accuracy of the information provided.
3.2 The client indemnifies Classicpoint.net against all third-party claims arising from any non-compliance.
3.3 The client is obligated:
3.3.1 To ensure that their information, such as profile, contact details, etc., is complete and truthful;
3.3.2. to use the services properly;
3.3.3. not to misuse access to the services and the services provided and to refrain from unlawful acts;
3.4. Classicpoint.net undertakes to activate the entries upon receipt of payment.
3.5. Classicpoint.net is entitled, but not obligated, to conduct a content review of the offers or entries.
3.6. Classicpoint.net makes no assurances whatsoever regarding possible placements and/or the order of search results when searching/researching the provider database.

4. Liability
4.1. Claims for damages arising from impossibility of performance, positive breach of contract, negligence in the formation of the contract, and tort are excluded both against Classicpoint.net and in relation to its vicarious agents and subcontractors, unless there is intentional or grossly negligent conduct. Classicpoint.net is not liable for consequential damages, in particular from the perspective of positive breach of contract.
4.2. Classicpoint.net is not liable for any damages that may arise from the fact that the user's and client's information can be viewed by other persons via technical transmission channels (Internet).
4.3. Classicpoint.net is not liable for the content of pages ported to the Internet. The respective providers of the websites accessed via a link are responsible for their content.
4.4. Classicpoint.net assumes no liability for indirect damages, consequential damages, or lost profits.
4.5. The client is personally liable for the content they create in the database with regard to unfair competition or other legal violations. The client shall indemnify Classicpoint.net in all cases against any damages resulting from content violations on the website, whether brought to Classicpoint.net by third parties or brought against Classicpoint.net by court order or injunction.

5. Miscellaneous
5.1. The place of jurisdiction for all entries on Classicpoint.net is Basel, Switzerland. All legal relations between the parties are governed by Swiss law.
